Since 9/7/9007, when the last Polrep was written, a compensation agreement was prepared to describe the extent of EPA's compensation for Ms. Garcia's loss of property. The agreement was signed by Ms. Garcia on December 6, 2007 and by EPA Division Director, Dan Opalski on December 7, 2007. Cliff Villa, ORC, mailed the signed document to Ms. Garcia's lawyer on December 18, 2007.
On May 4, 2008, OSC Parker picked up the loaned air matresses and air pump from Ms. Garcia. While she was there, Ms. Garcia mentioned that the stove burners still didn't work and there was a problem with the installation of the vinyl flooring. Discussions between Ms. Garcia's attorney and Cliff Villa followed.
On October 31, 2008, OSC Smith visited Ms. Garcia at her home to observe the problems she had reported and to determine if they were due to EPA work. OSC Parker agreed to have the leaking plumbing, damaged flooring and damaged stove repaired or replaced since they were due to poor workmanship by EPA contractor's.
On December 4, 2008, OSC Parker prepared a Request for Approval of 12 Month Exemption to the previous action memo. That document was signed by Dan Opalski on December 16, 2008.
On January 5, 2009, OSC Parker withdrew the Site from Washington state's Turbowaste.net database.
January 21, 2009, ERRS inspected the anticipated work and determined that they were partly at fault for the damage to the flooring due to incorrectly installing it with the wrong nails and glue. They agreed to pay for half of the repair work and the contracting officer accepted their offer.
On March 16, 2009 ERRS started work and got a plumber to repair the leaking plumbing, Home Depot replaced the stove as it could not be repaired and a subcontractor, Great Floors, moved out the Garcia's belongings, removed and replaced the subflooring and vinyl flooring, moved the Garcia's belongings back in and reinstalled the plumbing fixtures.
