The KM Ventures facility previously operated as Yorkshire America, a textile dye manufacturer. During late August 2009, OSC Ken Rhame conducted a site inspection with NC DENR and local authorities and discovered hundreds of drums of dye and dye intermediates in various conditions as well as several above ground storage tanks which contained residual caustic and acids. The facility is located on a 42-acre tract with 14 acres fenced around the plant. The facility is also bordered on the southeast by the Catawba River.

In October 2009, KM Ventures agreed to an Administrative Order with EPA Region 4 which included a scope of work to conduct the clean up.

During January and early February, 2010, KM Ventures continued segregating the remaining drums stored in Building 3 into shipment classes for their international broker, Jaychem Inc. Six loads of drums (approx 300 drums) and dye powder were prepared for shipment. Shipment of these loads was to begin in late January, but unforseen delays from Jaychem resulted in several of these shipments being delayed into late February. On February 19th, two loads of dye products and drums were shipped off-site by Jaychem.

In mid January, KM Ventures also hired Phillips Services Corp (PSC) to assist with the proper disposal of lab packs and hazardous material from the site. PSC chemists were on site Jan 15th to conduct additional "haz- catting" to arrange the remaining lab packs and hazardous materials into waste streams. On February 20th, 13 totes containing approximately 4000 gallons of dye waste was shipped to PSC's Republic facility in Hatfield, Pa for disposal.

KMV to continue coordinating remaining drum shipments with Jaychem and Phillips Services.
