1.1.1 Incident Category
This is an emergency action to address an oil discharge at a former auto shop. 

1.1.2 Site Description
The Site is a former automobile repair facility in an industrial and commercial area of Memphis, TN.  The Site is less than 0.5 acres in size with the majority of the property covered by a large building.  The remaining areas of the property are covered with concrete or asphalt.  Upon arrival to the scene, EPA noted a 275 gallon tote containing a small quantity of suspected oil.  A large oil stain and oily liquid was noted originating at the tote and traveling across the asphalt to an unlined ditch.  Oily liquids were also observed in the low area associated with an off-loading elevated dock.  The oil had traveled approximately 200 feet in the ditch.  The ditch discharges to Days Creek, a tributary to the Noncomah Creek, which flows to the Mississippi River.

1.1.2.2 Description of Threat
The oil has discharged to a ditch which flows into a navigable waterway.  Sufficient oil quantity was present to result in a sheen on a surface water if storm water carried the oil further downstream.  The closest surface water body is Days Creek approximately 560 feet to the east.

  2.1 Operations Section
    2.1.1 Narrative
On August 3, 2012 Tennessee Department of Conservation (TDEC) requested EPA assistance to address oil discharging from the closed automobile repair facility. 

2.1.2 Response Actions to Date
On August 3, 2012, EPA On-Scene Coordinator Spurlin mobilized to the Site at approximately 1500 hours CST, arriving at the Site at approximately 1615.  Due to the site conditions and the threat of oil discharging to a navigable waterway, OSC Spurlin initiated an emergency response to clean up the oil.  U. S. Environmental Services (USES), a team subcontractor to WRSCompass, responded to the Site.  USES utilized absorbent pads, a vacuum truck, absorbent materials, and hand tools to recover and containerize the oil.  An total of 2280 gallons of oily waste water was transported via vacuum truck to Cummings Environmental Services Company, Memphis, TN.  The material will be recycled as a used oil.  Five 55-gallon drums containing oily solids were also generated. EPA collected samples of the material to plan for future disposal, and later provided the data to the owner who intended to conduct the remaining work.  The oily solids in the ditch required excavation, and the waste generated by the excavation and the five 55-gallon drums required disposal.

On August 10, 2012, EPA returned to the Site.  The owner had hired a contractor to excavate the oily ditch.  The contractor excavated the oily material and backfilled the ditch with clean soil.  The actions generated an estimated 100 tons of oily soils.  The owner planned to transport the material to the Waste Management landfill near Tunica, Mississippi.  The owner covered the material with plastic to prevent runoff while he arranged for disposal.  EPA and TDEC periodically checked on the status of the Site and the disposal progress.

2.1.3 Enforcement Activities, Identity of Potentially Responsible Parties (PRPs)
The property is vacant.  After the initiation of the response, the OSC was able to contact the property owner, who indicated a potential willingness to perform the remaining work.  The current owner information and information regarding the last tenant is documented in the site file.  The current owner was issued a Notice of Federal Interest letter and a Notice of Federal Assumption letter by the OSC.
