Current Activities

Greka has completed the following items:

1. Restoration of the Firestone Winery warehouse yard and the road leading to the warehouse.
2. Installation of a cinder block wall around the Davis Tank Battery to replace the berm comprimised by the spill.
3.  Removal and replacement of the drainage culver from the secondary containment.  The removal of the pipe was witnessed by EPA, SBCo. Petroleum and CADFG.
4.  In late April OSC Wise provided Greka with an extension until May 15, 2008 to remove the liquids from the portable storage tanks.  Greka failed to perform this task.  The majority of the material was removed from the tanks, however 1-3 feet of residual cleanup waste was left in the tanks.  Greka was verbally notified that they were in violation of the Order and no further extensions of the Order would be allowed.  Greka was informed that they could be fined $32,500 per day per tank for each day the tanks were not emptied and clean.  On May 22, 2008, OSC Wise and PST observed a Greka contractor (Speeds Vacuum Truck Services) making an illegal permit required space entry to clean tanks owned by Pacifc Petroleum.  Speeds failed to meet even the minimum requirements pursuant to 29 CFR 146:  Permit Required Confined Space Standard during their entry.  OSC Wise stopped the entry and informed Greka that Speeds would not be allowed to make any additional entries into the tanks.  OSC Wise also filed a complaint with CALOSH on this matter.  Greka subsequently hired another contractor to clean the tanks.  The cleanup of the tanks was completed on June 6, 2008.

Key Issues

Greka will be hydro-testing the wastewater tank on June 16, 2008.  It is anticipated that the lease will be turned back on.  This will be done under EPA oversight.
