1.) ERRS crew completed the load-out and off-site disposal of F-listed, hazardous soil and debris. ERRS loaded and transported 1099.16 tons of arsenic-contaminated soil and debris to the Wayne Disposal Site No. 2 Landfill in Belleville, Michigan. 2.) ERRS completed the loading and off-site disposal of one roll-off dumpster of non-hazardous, non-regulated waste. ERRS crews loaded and transported 25.94 tons of non-hazardous, non-regulated debris to the Montgomery County Sanitary Landfill in Jeffersonville, KY. 3.) ERRS completed the loading and off-site disposal of two drums containing F-listed, hazardous liquids. The drums were disposed at the Michigan Disposal Waste Treatment Plant in Belleville, Michigan. 4.) ERRS completed backfill and final grading at the former Treatment Building B area. 5.) An ERRS subcontractor used a hydro-seeder to install grass seed at the former Treatment Building B area. 6.) An ERRS subcontractor completed fence installation along Holly Avenue. 7.) ERRS completed construction of a temporary cap in areas of the site where historical arsenic contamination greater than 160 ppm total arsenic remains at the surface. The temporary cap was constructed by placing geotextile fabric and then covered with dense grade aggregate. 8.) ERRS crew grouted an on-site drainage pipe, prior to temporary cap installation. 9.) ERRS removed accumulated sediment from the stormwater outfall structure. The sediment was placed in drums for later disposal. 10.) START performed XRF sampling and documented site activities with photos and logbook notes.

On Nov. 12, 2008, CSX Transportation, Inc. (CSXT) was awarded possession of all real and personal property at the Site through a Master Commissioner's Sale. CSXT is preparing a Work Plan to propose a PRP-lead removal action which will address remaining contamination at the Site where total arsenic exceeds 160 ppm. This final phase of the removal action is scheduled to begin in 2009.

-An additional $6,000 in funding was re-allocated from the extramural costs contingency to pay for aerial photography services rendered by EPA Region 4 SESD. (See 12/03/08 re-alocation memo posted in the documents section at www.epaosc.net/kywood).
-KDEP considers arsenic-containing soils at concentrations above a regional average background level of 13.12 ppm to represent a threat to human health. Several properties adjacent to the site exhibit arsenic at concentrations exceeding 13.12 ppm. KDEP sent letters to neighborhood residents in September 2008, requesting permission to sample for arsenic in off-site areas. KDEP is currently in the process of evaluating XRF data collected in residential areas within close proximity to the KY Wood Site. KDEP's decision on whether to initiate a state-lead cleanup of areas near the KY Wood Site is pending review of the XRF data.
