1.1 Background

The Ellman Battery Company operated a lead acid battery company from 1962 to 1991. The operations included battery sales and demolition activities for the recovery of lead components.  Waste disposal records for this company were not available, however, battery casings and lead fragments can presently be observed in the soil along the southern portion of the property. A sampling investigation performed by the Florida DEP revealed lead concentration in the soil ranging from 470 to 19,000 mg/kg at the site.

    2.1 Response Actions to Date

On September 1, 2009, EPA mobilized to the site. START support was utilized initially to perform sampling at a property adjacent to the Ellman Battery site.  The purpose of this sampling event was to assess potential migration of contamination from the Ellman property to the adjacent property located downgradient of the site. The lab results indicated that site contaminants had not migrated beyond the Ellman property. 

WRS, the ERRS contractor for EPA mobilized to the site on September 9, 2009. A staging area was established following screening of the surface soils by XRF and clearing and grubbing operations were performed. A system of grids were projected over the area of contaminated soil.  Excavation activities began at the northwest corner of the grid system and progressed in an easterly direction. Initially a one foot lift of soil was excavated and the underlying soil screened with an XRF.  If the screening values for lead were greater than 1000 ppm an additional one foot of soil was excavated from the corresponding grid section. A conservative screening value of 1000 ppm lead via XRF was utilized. Additional samples (confirmation samples) were collected by START contractor and sent to a fixed base lab for analysis. 

The maximum excavation depth for any given section of the grid was generally limited to four foot below land surface. If the XRF demonstrated lead concentrations greater than 1000 ppm at this depth for any section of the grid, a notification barrier (orange mesh fence) was used to line the bottom of the excavation. Clean fill material was used to backfill each section of the grid. The highest lead levels were observed at the southwest section of the property. This area was cluttered with battery casings to at least four foot below land surface.

The contaminated soil was sampled and the results indicated that the waste would be considered as hazardous by characteristic for lead. Therefore a treatability study was performed on the contaminated soil using multiple concentrations of Triple Super Phosphate (2%, 4%, and 6% by weight). The lab results indicated that a concentration of approximately 3% TSP would be the most cost effective mixture. 

The stockpile of contaminated soil was blended with a 3% mixture of STP and a sample was collected for a waste disposal profile. The results demonstrated that the lead concentrations in the treated soils (0.04 ppm)were below the 5 ppm requirement for toxicity characteristic. Therefore the soils were sent to a subtitle D landfill for disposal.  The site was regraded and gravel utilized to stabilize the underlying soil and prevent erosion. The crew completed these activities and demobilized from the site on October 15, 2009.


2.2 Enforcement Activities, Identity of Potentially Responsible Parties (PRPs)
EPA has contacted the Potentially Responsible Parties (PRPs) for the Site on multiple occasions and negotiated with the PRPs to have them perform the necessary removal action at this Site. Ultimately the PRPs were unwilling to perform the work.
