Site Description
On June 27, 2007, U.S. EPA ordered The Dow Chemical Company (Dow) to negotiate an Administrative Order on Consent, to address removal of extremely elevated levels of dioxin-contaminated soil from an eroding river bank within Reach JK of the Tittabawasse River near Midland, Michigan. Dow agreed to the terms of the Order and on July 12, 2007, the Order was signed by the Regional Administrator and Dow. For additional background information please see the site profile.

Reach JK was divided into two areas. The area along the river bank where contaminated soil was excavated was designated JK-1, and an area further back from the river bank where clean soil was used to cap contaminated soil was designated JK-2.

On-Scene Coordinators (OSC) Jim Augustyn and Brian Schlieger provided oversight with assistance from U.S. EPA’s START Contractor, Weston Solutions, Inc.


Current Activities
The following tasks have been completed by Dow during the period from September 27 – November 26, 2007:

• The installation and removal of the temporary irrigation system which provided water for the newly planted grass seed and trees.
• The installation of approximately 280 bare root trees in the JK-1 and JK-2 non-wooded areas.
• Placement of straw mulch and mulch blankets in the JK-1 and JK-2 non-wooded areas.
• Removal of all silt fence.
• Removal and decontamination of the turbidity curtain.
• Re-installation of the MDEQ Health Advisory signs along the river.
• Warning signage has been installed on the JK-2 wooded area perimeter chain-link fence.
• Decontamination and demobilization of all heavy equipment and construction materials.
• Demobilization of the site office trailer.
• Removal of the orange construction fence used for site security.
• The temporary asphalt and crushed limestone access road and parking area will remain in-place.



Planned Removal Actions
No additional planned removal activities are anticipated for this site under the current Administrative Order on Consent (AOC).

Key Issues
Dow submitted a Final Site Report as required by the Settlement Agreement on February 28, 2008.  The Final Report was approved by USEPA on May 2, 2008.

Dow estimates its final removal cost for this site to be $1,922,000


 
Disposition Of Wastes
As of 9/19/07, Dow has removed and transported to the Salzburg Road Landfill approximately 23,562 in-place cubic yards of impacted soil from the Reach JK site. The following is a schedule of the disposed waste excavated from the JK-1 Cut #1 area:
