During this reporting period the Responsible Party's contractor, ERM Inc., continued weekly oil extraction activities. The total liquids extracted thru 01/31 includes 24,286 gals of contaminated water and 3,606 gals of fuel oil. Weekly extraction events will continue. Recovered diesel is transferred to a new permitted AST at the Fogle's facility for disposal. Following each extraction event, the contaminated water was passed thru a series of carbon filter units to a 500 gal holding tank. Water was than discharged to stream as per NPDES permit. A sample of this efluent was retrieved on 01/03/06 and tested for benzene, ethylbenzene, toluene, total xylenes, methyl tert-butyl ether and tert-butyl alcohol as per the permit. ERM and Fogle's personnel will continue to inspect and replace sorbents in the creek as part of the required work under this AOC.
On January 09, 2006 ERM and its subcontractor mobilized to the site to initiate excavation activities of Anomaly E as per the Abatement Plan. After not being able to detect the source, on January 16, 2006, ERM returned with reps from Forrest Enviro. The area was rescanned with the EM-31 equipment and some excavation revealed the anomaly to be conduit transporting electric wires to the pump at the 10K AST. It was determined that this anomaly could not have contributed to this site. Therefore the only area in need of excavation is the area in the vicinity of the 10K AST.

Responsible Party (Fogle's) has formally requested that MDE allow removal of contaminated soils from the 10K AST location to their "landfarm" at 1711 Dennings Rd., New Windsor.
