Current Activities
During this reporting period the Responsible Party's contractor, ERM Inc., continued weekly oil extraction activities.   The total liquids extracted thru 05/31/06 includes 27,072 gals of contaminated water and 3,704 gals of fuel oil.  Weekly extraction events will continue.

During this reporting period the FOSC met on site with Fogle's and ERM representatives (5/11)
to go over the Extent of Contamination Study Report and to review site activities.  ERM reps noticed a small stained area with diesel odor located southwest of the underflow dam.
Further inspection revealed that the staining was resulting from upwelling of ground water and oil from a vertical 6-inch diameter PVC pipe that was cut off beneath the ground surface. The shallow impacted soil around the pipe was removed and placed in a rolloff container at the Fogle’s Facility for future disposal. The vertical 6-inch PVC pipe is believed to be part of the oil recovery trench installed by the Army Corps of Engineers (ACOE) in December
2004. Also, part of this oil recovery trench are four additional vertical 6-inch diameter PVC pipes located adjacent to and parallel with the creek. Fogle’s and ERM will conduct activities in June 2006 to determine the construction of the recovery trench and if recoverable oil is present within the trench. It is anticipated that a video survey of the 6-inch PVC pipes to determine the placement of well screens, excavating (and possibly replacing) the buried 6-inch PVC pipe, and pumping from the four intact 6-inch PVC pipes will occur.

        
ERM and Fogle's personnel will continue to inspect and replace sorbents in the creek as part of the required work under this AOC.

Fogle's submitted to the FOSC, in accordance with the AOC, a plan for In-Situ Bio Remediation of the source area (AST).  This is a change to the previous planned excavation and removal of contaminated soils.  The FOSC has approved the new concept.  This would alleviate the need to excavate large portions of the Fogle's parking lot and allow Fogle's to continue funding of this action while maintaining an aggressive abatement and mitigative approach to the seep areas.



Next Steps
FOSC to meet ERM on site on June 28 to assess the new seep and to assess the mitigative measures applied by ERM.
