Current Activities
During this reporting period the Responsible Party's contractor, ERM Inc., continued weekly oil extraction activities.   The total liquids extracted thru 06/30/06 includes 31,105 gals of contaminated water and 3,735 gals of fuel oil.  Weekly extraction events will continue.

During this reporting period the FOSC met on site with Fogle's and ERM representatives on June 21.   As mentioned in Polrep 21, ERM previously noticed a small oil stained area southwest of the underflow dam.  Further inspection revealed a 6inch PVC pipe left behind during the USACE initial trenching operations to ascertain the extent of lateral seepage. Fogle's retrofitted this standpipe so that extent of oil accumulation can be determined. On June 21 an extraction of 1.5 gallons of oil was retrieved.  As a result, Fogle's obtained the necessary permits from Carroll county in order to replace this well and to install an additional three wells, in the general vicinity, to better determine extent of contamination in this area.  
        
ERM and Fogle's personnel will continue to inspect and replace sorbents in the creek as part of the required work under this AOC.

Fogle's submitted to the FOSC, in accordance with the AOC, a plan for In-Situ Bio Remediation of the source area (AST).  This is a change to the previous planned excavation and removal of contaminated soils.  The FOSC has approved the new concept.  This would alleviate the need to excavate large portions of the Fogle's parking lot and allow Fogle's to continue funding of this action while maintaining an aggressive abatement and mitigative approach to the seep areas.  Pending completion of the Plan for the aforementioned In Situ Bio Rem, the EPA FOSC and Fogle's/ERM agreed to present this plan to both EMA (property owner) and MDE spill response program.  It is anticipated that this will occur over the next couple of weeks.  



Key Issues
The EPA FOSC, after discussion with the USCG-NPFC Case officer has requested the USACE to provide all intramural and extramural cost accounting documents for cost recovery purposes.  The USACE has acknowledged this request and is currently pulling them together.
