2.1 Operations Section

2.1.1 Narrative
The cleanup is being directed by a Unified Command consisting of the EPA OSC, the CADFG Office of Spill Response and Prevention Game Warden (State IC), OCPW and Huntington Beach Fire Department (HBFD). The cleanup is being conducted Orange County Public Works. (OCPW).
2.1.2 Response Actions to Date

Ocean Blue completed the decontamination of the City of Huntington Beach's underground storm drain system to the City's satisfaction. Ocean Blue is continuing to decontaminate the walls of the storm drain using hotwater pressure washing. The oil and sheen generated during the cleaning is being caught in sorbent booms or collected using a vacuum truck. During the decontamination, large areas of the wall's protective coating are coming off. After consultation with DFG biologists it was determined that the paint chips needed to be collected. Ocean Blue built catching devices to be used in areas where the oil covered paint chips are coming off during the pressure washing.
EPA is cooperation with the Huntington Beach Department of Public Works (HBDPW), the California Department of Toxic Substance Control and DFG are currently evaluating the second version of the work plan and the first version of the sampling plan provided by Angus Petroleum as required under the Clean Water Act Order issued to them by OSC Wise. The Order requires a Work Plan to outline how the lateral to the storm drain from their clarifier and the clarifier itself are to be removed. EPA and the cooperating agencies have already reviewed the first version of the work plan. The plan was returned to Angus as inadequate with comments. EPA has directed Angus to replace there original contractor due to the contractor's lack of compliance with 29 CFR 1910.120: HAZWOPER. The contractor was unable to prove compliance with 29 CFR 1910.120(b) requirements. Angus has subsequently retained Patriot Environmental Services to conduct the work.
On 02/12/2010, the previous operation period ended and a new one began at 1000 hours. A new Incident Action Plan was prepared by Ocean Blue and DFG. It was reviewed and signed by OSC Wise. This operation period will last until 02/19/2010 at 1000 hours.

See POLREP No. 1. EPA in cooperations with DFG (lead) is investigating the cause of the spill. EPA CID is participating in this investigation along with OSC Wise.

2.2 Planning Section

2.2.1 Anticipated Activities
Cleanup activies are four fold. First is the decontamination of the channel. This will be continued by Ocean Blue until completed. Second will be the activities at the Angus facility. This is being overseen by EPA under a Clean Water Act 311(c) Order (CWA Order). These activities will include the removal ofthe clarifier, the lateral to the 24" storm drain lateral and soil characterization and removal of needed. Third will be the assessment of sediment contamination in the channel. The EPA START Contractor is currently preparing a Sampling and Analytical Plan (SAP). The SAP will be reviewed by the Unified Command and cooperating agencies. The SAP will be executed by the EPA START Contractor, the USCG PST and cooperating agencies. Fourth will be the removal of any contaminated sediment in the channel if needed. The removal of sediment will be conducted by either the EPA Emergency and Rapid Removal Services (ERRS) contractor or by Angus's contractor. If Angus is directed to conduct the sediment removal, the CWA Order will be amended to reflect this.
2.2.1.1 Planned Response Activities
1. Under the CWA 311(c) Order, the PRP will decontaminate and remove or abandon in place the clarifier that overflowed. All plumbing from the clarifier to the Huntington Beach's storm drain system will removed. The PRP has until February 3, 2010 to provide a workplan for this activity.
2. Under the CWQ 3119c) Order, the PRP must determine how the spill occurred. Once the clarifier is clean, all connections into the clarifier will be identified and their path traced.
3. Ocean Blue shall decontaminate the channel, collect all oil and sheen and dispose of contaminated debris and water. Once the oil has been quantified by DFG, Angus will be allowed to collected it and transport it back to their facility.
4. The EPA START contractor is currently preparing a SAP for the assessment of channel sediment. The action level for the sediment assessment shall be 1,000 ppm total petroleum hydrocarbons. The SAP will be reviewed by the Unified Command and any interested agencies. If the assessment documents the presence of oil above the action level, sediment removal planning will be initiated.
2.2.1.2 Next Steps
Ocean Blue will continue the decontamination of the channel. There will be no weeked operations. Ocean Blue will be providing a 2 man boom team to manage the spill course over the weekend.
2.2.2 Issues
Although the source of the spill has been discovered, the cause is still under investigation by EPA and CADFG.
The spill cleanup must be completed before March 15, 2010 to allow for the Wetlands Conservancy to open the Magnolia Wetlands to the channel.
