2.1.2 Response Actions to Date

U.S. EPA arrived at the site on October 8, 2010 and addressed the leaky tanker. The ERRS contractor, Environmental Restoration (ER), sampled the contents and stopped the leak.  Sample results yielded a pH value of 7.

The Bankruptcy Trustee and Pike Fire Department toured the facility on October 8.

U.S. EPA has arranged for site security, collected samples, developed a draft storm water contingency plan and made arrangements for disposal on 10/12 of hydrogen peroxide and sodium hydrosulfide. During further evaluation of the facility, a sign displaying "Caution Radioactive" was observed in the Laboratory.  There are at least 4 pieces of equipment that use a radioactive source. Several buildings and flammable container cabinets were locked during inspection.  The master set of keys to the facility was found and samples have been taken from the previously unaccessable areas.

A total of 33 samples were taken from various tanks and drums on site.  Each sample was tested for hazardous characterization (HazCat).  It was determined that five of the samples had "questionable" levels of chlorine, indicating the potential for PCB contamination.

On 10/12/10, the five "questionable samples from the HazCat analysis were submitted to Pace for laboratory analysis of PCBs and TCLP Metals.  The samples were submitted for standard 7-day turnaround time and the results are expected next week.

On 10/13/10, 900 gallons of hydrogen peroxide and 300 gallons of sodium hydrosulfide were transported off-site to EQ Detroit, Inc. located in Detroit, MI.  The hydrogen peroxide is being disposed of while the sodium hydrosulfide is for re-use.

On 10/15/10, 4100 gallons of sodium hydroxide was transported off-site for re-use at United Waste Water located in Cincinnati, OH.  The analytical results for the West Million Tank and East Million Tank samples were received from Pace Analytical.  All PCB results were non-detect.  Detectable amounts of arsenic (0.82 mg/L) and barium (0.671 mg/L) were found in the EMT sample, while detectable amounts of barium (0.547 mg/L) and chromium (0.178 mg/L) were found in the WMT. 

One sludge sample was collected from the storm sewer manhole (ESI-SEWER01-101510) and frac tank 10 (ESI-FRAC10-101510) for the following laboratory analyses: PCBs, TCLP (VOC, SVOC, Metals), Total Metals, pH, and flashpoint.  ERRS hand delivered the samples to Pace Analytical for 24 hr turnaround time.  The frac tank sample is two phases and analyses will be run on the oil and water phase.

From 10/12/10 thru 10/15/10, laboratory pack inventory was conducted.  All buildings on-site were investigated for miscellaneous containers and were collected and staged in one area.  Approximately 1,623 sample containers were located in Building 6 and approximately 678 sample containers were located in Building C.  These sample containers were dumped into the solidification tank located on-site.

The vacuuming of the storm sewer system began and material was off-loaded into on-site frac tank 10.  The material in the concrete access pit was pumped into the West Million Tank in order to continue with the storm sewer system clean-out.

Vacuuming of the storm sewer system and concrete access pit will continue next week.

2.1.3 Enforcement Activities, Identity of Potentially Responsible Parties (PRPs)

On September 23, 2010, verbal notice was given to ESI. Also a Unilateral Order was sent to ESI. ESI , of course, was not able to comply because they declared Chapter 7 Bankruptcy on October 1, 2010.

The City of Indianapolis has received two odor complaints regarding this facility.  In addition, Pike Fire has in the past received complaints regarding this facility. START is researching masking agents that could be used since some of the tanks are open top.

Pending approval of the storm water contingency plan, measures will be taken to manage on-site storm water run-off during a significant rainfall event. Rain has been forecasted for next week.
