2.1.2 Response Actions to Date
From 10/18/10 thru 10/22/10, storm sewer system vacuuming continues. Material is being off-loaded into on-site frac tank 11. Lab results were received for frac tank 7, 8 and 9 along with the transfer tank and south pit of the oil water separator. PCBs were not found in any of the containers. Trace amounts of chromium, barium and lead were present in the south pit. Trace amounts of chromium and barium were present in the transfer tank.
One waste water sample was collected from the storm sewer manhole (ESI-SEWER01-102110) and frac tank 10 (ESI-FRAC10- 102110) for the following laboratory analyses: oil and grease. ERRS hand delivered the sampleas to Pace Analytical for a 5 day turnaround time.
The site API tanks have been covered with their lids.
There was a conference call on 10/22/10 regarding storm water management plans. Possible solutions included the use of a pig to stop flow between the million gallon tanks and concrete access tank and using dandy bags to prevent solids from entering the sewers.
On 10/22/2010, City of Indianapolis, Department of Public Works personnel Mark Richards, Richard Wise, and Tom White arrived onsite and took a water sample from the API tank. The API water sample was sent for analysis using the required analyical Method 136, which was necessary for discharge into the sanitary without treatment. U.S. EPA will be notified of the results.
Vacuuming of the storm sewer system and concrete access pit will continue next week.
2.1.3 Enforcement Activities, Identity of Potentially Responsible Parties (PRPs)
On September 23, 2010, verbal notice was given to ESI. Also a Unilateral Order was sent to ESI. ESI , of course, was not able to comply because they declared Chapter 7 Bankruptcy on October 1, 2010. On October 25th 30 104E information request letters were sent to PRPs.

2.2.1.2 Next Steps
The City of Indianapolis has received two odor complaints regarding this facility. In addition, Pike Fire has in the past received complaints regarding this facility. START is researching masking agents that could be used since some of the tanks are open top.
Pending approval of the storm water contingency plan, measures will be taken to manage on-site storm water run-off during a significant rainfall event. Rain has been forecasted for next week.
