2.1.2 Response Actions to Date
From November 8 until November 12, 2010 ERRS backfilled the stormwater sewer cap between the northeast and southwest areas just north of manway SS17 with soil and concrete. Stained subsurface soil from the stormwater cap excavation and site PPE were hauled off site to Southside Landfill in Indianapolis, IN for disposal. The last of the three berms were constructed to control surface stormwater. Results of the AreaRAE air monitoring have been posted along with an AreaRAE location map under the Documents section. ERRS completed hauling out oily water from the west million-gallon bunker tank and frac tanks 7, 8, 9, and 10. The remainder of any material in frac tanks 7, 8, 9, and 10 was pumped to the west million-gallon bunker tank. There is now 94 inches of freeboard in the west million-gallon bunker tank, 39 inches of which was created by pumping out oily water for re-use at United Wastewater.The sample waste located in the center solidification pit was solidified using on site fly ash and approximately 25 cubic yards of imported mulch.
The Indianapolis Department of Public Works has been monitoring the West 86th Street manhole shared by ESI, Asphalt Materials, and Crider & Crider Construction. There appears to be 1 -2 gallons per minute being discharged from the ESI line. (Manhole Photographs are available in the Images Section.) ERRS has closed valves and emptied out liquid lines as a result of these manhole observations. In addition, the partial flume in Building 2 shows no flow.
The Trustee has repaired a breach in the fence and posted additional "No Trespassing" signs.

- The water shut-off previously proposed in POLREP # 4 was not implemented during this reporting period.
- Lab Inventory and labpacking will be handled by Trustee.
- The Hearing held on November 10 resulted in the Judge allowing WSP, ESI's insurance company's environmental consultant, to begin their work at ESI on tanks 51, 43, and 44

U.S.EPA and START will be on site while WSP is working. WSP is expected on-site on November 15 at 9 am Eastern. Utilies and security will be taken out of the name of the ERRS contractor and taken over by WSP.
A stormwater contingency plan will be posted in the next two weeks which will include an estimate of the amount capacity created as a result of the berms and cap in addition to weather conditions that might cause a "release".
