2.1.2 Response Actions to Date

From January 14 until March 2, 2011

 

  • On January 12, 2011 Tom White and Mark Richards from the City of Indianapolis POTW were on site to collect a stormwater sample for discharge parameter analysis.
    • T. White and M. Richards collected one sample from the stormwater discharge into the City sanitary sewer pumped from manway SS17 in a series of VOA, amber, and plastic jars.
    • T. White requested the stormwater pump run for 5-10 minutes prior to sampling, as a result ERRS discharged 7,280.2 gal of stormwater from the southwest area to the City of Indianapolis sanitary system.
  • On January 19, 2011 ERRS hauled out 6 loads (33,640 gal) of oily water from the west million gallon bunker tank for disposal at United Water in Cincinnati, OH.
  • On January 19, 2011 ERRS discharged 46,717.6 gal of stormwater from the southwest area to the City of Indianapolis sanitary system, for a total of 53,997.8 gal of the allotted 120,000 gal in the SDA issued on January 3, 2011.
  • On January 24, 2011 per PTFD Steve Jones, in order to have the site fire protection system operational the following actions are required to be completed:
    • Unloading Building: No materials can be stored within 30 ft of the building and all materials must be removed from the building interior.
    • Solids Building: No materials can be stored within 30 ft of the building, all tanks must be emptied from the building interior, all tanks outside of the building must be emptied, and all rolloffs/frac tanks outside of the building must be removed.
  • On February 14, 2011 ERRS discharged 57,674 gal of stormwater from the southwest area to the City of Indianapolis sanitary system, for a total of 111,671.8 gal of the allotted 120,000 gal in the SDA issued on January 3, 2011.
  • On February 14, 2011, City of Indianapolis POTW personnel were on site to collect a stormwater sample for discharge parameter analysis.
  • On February 15, 2011 the City of Indianapolis modified the SDA originally dated January 3, 2011 for an estimated 1 million gal of additional stormwater from the southwest area to be discharged to the City sanitary sewer system. The SDA was contingent on the stormwater sample meeting the required sanitary sewer discharge criteria and the SDA expires on December 31, 2011. Stormwater sampling is required every other month and the City has agreed to monitor the discharge for the months of March, May, July, September, and November while the U.S. EPA has agreed to monitor the discharge for the months of April, June, August, October, and December.
  • On February 15, ERRS took stormwater sample ESI-SWSEWER-021511 from manway SS17 and submitted it to Pace for City sanitary sewer discharge parameter analysis.
  • On February 15, 2011 ERRS discharged 64,010 gal of stormwater from the southwest area to the City of Indianapolis sanitary system, for a total of 120,000 gal of the allotted 120,000 gal in the SDA issued on January 3, 2010 and 55,681.8 gal of the allotted 1 million gal in the modified SDA issued on February 15, 2011.
  • On February 15, 2011 Venezia, Inc. removed the fly ash-containing tank from the north end of the site.
  • On February 15, 2011 ERRS hauled out 12 loads (65,470 gal) of oily water from the west million gallon bunker tank for disposal at United Water in Cincinnati, OH.
  • On March 2, 2011, ERRS discharged 117,183 gal of stormwater from the southwest area to the City of Indianapolis sanitary system, for a total of 172,864.8 gal of the allotted 1 million gal in the modified SDA issued on February 15, 2011. 
  • On March 2, 2011, ERRS hauled out 10 loads (59,000 gal) of oily water from the west million gallon bunker tank for disposal at United Water in Cincinnati, OH. 

2.1.3 Enforcement Activities, Identity of Potentially Responsible Parties (PRPs)

A draft Administrative Settlement Agreement on Consent (ASAOC) is currently being negotiated with PRPs.
