1.1.1 Incident Category
The site is currently a Reponsible Party lead Emergency Removal Action.
1.1.2 Site Description
The Site is a former ink manufacturing facility that produced water and oil based printing inks for the tile, wall paper, food packaging and pharmaceutical industries. The company ceased operations and entered into Chapter 7 Bankruptcy sometime in December of 2010. A tour of the facility conducted by EPA on June 8, 2011 indicated that the facility contains a manufacturing area, two laboratories and a loading dock that house approximately 350 drums and potentially over 1,500 laboratory-sized containers of chemical products, finished inks and flammable hazardous wastes. Utilities to the facility were shut down some time over the winter, resulting in freeze damage to the fire suppression system and loss of the security system. The storage of flammable hazardous wastes with no fire suppression system or site security has prompted the Cinnaminson Fire Department to issue a Notice of Imminent Hazard to the property owner and the Bankruptcy Trustee. The NJDEP verbally requested EPA assistance on June 8, 2011 to mitigate the immediate hazards at the Site.
1.1.2.1 Location
The Del Val Ink and Color Site is located in a mixed light industrial/residential neighborhood at 1301 Taylors Road, Cinnaminson, New Jersey.
1.1.2.2 Description of Threat
There are currenty 14 fifty five gallon drums of flammable hazardous wastes along with a large quantity of other chemical products. Some of the wastes and products are stored on the exterior loadng dock of the facility; the building is currently unoccupied with no power, security system or fire suppression system in place. A Notice of Imminent Hazard has been issued by the Cinnaminson Fire Department as a result of the current storage conditions of these materials.
1.1.3 Preliminary Removal Assessment/Removal Site Inspection Results
The NJDEP verbally requested EPA assistance to mitigate the immediate threats posed by the facility on June 8, 2011. At that time NJDEP requested an EPA presence on site to attend a meeting between the NJDEP, the Cinnaminson Fire Marshal and representatives from Del Val Ink and Color. Two EPA OSCs responded to the request to conduct an investigation that included meeting with all parties to discuss the current situation and a preliminary visual inspection of the facility. The results of that investigation indicated the following:
- The Del Val Ink and Color facility is currently in Chapter 7 bankruptcy and under the control of a Federal Bankruptcy Trustee. The facility property and building are currently owned by Homet Realty Corporation which is believed to be a viable company.
- The Cinnaminson Fire Marshal had issued a Notice of Imminent Hazard due to the storage of flammable hazardous wastes, the fact that the fire suppression system was inoperable (due to freeze damage from the winter) and the lack of security at the site. It was indicated to EPA that the site owner and the Trustee have been unresponsive to NJDEP and Fire Department requests to mitigate the hazards at the site.
- There are 14 drums of flammable hazardous wastes stored on the loading dock along with other chemical drums and evidence of a previous spill. Some of the hazardous waste drums carry labels dated 2009. There are also four solvent tanks that were reported as empty.
- There are approximately 350 drums of mixed chemicals and wastes stored both on the loading dock and inside the facility. The majority of the drummed chemicals are currently being considered for sale at auction by the Trustee. No schedule for that auction was available.
- There are two laboratories on-site that house well over 1,000 containers of laboratory chemicals and product samples.
- A full inventory was not conducted by EPA during this preliminary site visit. EPA requested a complete inventory from the Potentially Responsible Party (PRP); that inventory is currently being evaluated by EPA.
- A waste broker, acting on behalf of the PRP was in the process of collecting samples from the flammable hazardous waste containers for disposal purposes.
- A representative for the PRP stated that he was unsure if there were adequate liquid assets at this time to provide for the disposal of the 14 hazardous waste drums or to make repair to the fire suppression system, however; he was in the process of exploring those options with the Trustee. He also stated that he would try to resolve those issues by the end of next week.
- There was a report of vandalism at the facility as well as evidence from this event. There is the potential for this type of activity to increase due to the fact that the facility is now vacant, there is no electrical power to the building and the facility grounds are not being maintained, giving the appearance that the facility is completely abandoned. The heavy guage copper wiring inside the building is an attracton to potential scavengers. Easy access to potential vandals and/or scavangers is provided by a wooded area located adjacent to the facility.
- Two detectives from the NJ State Attorney General's office responded to the Site to provide assistance and determine the need for a criminal investigation. There does not appear to be a need for a criminal investigation at this time, however; the detectives will remain engaged in monitoring site progress as needed.

EPA is currently investigating response options for this Site. EPA Region 2 Office of Regional Council has assigned an attorney for the Site.
2.1.2 Response Actions to Date
EPA conducted a preliminary site inspection on June 8, 2011 and is working with the PRP and the Bankruptcy Trustee to determine who will take the lead in mitigating the immediate hazards at the site.

The Potentially Responsible Parties (PRPs) are Del Val Ink and Color, Inc. and Homet Realty Corporation.
