1.1.1 Incident Category

Time-Critical Removal Action under CERCLA

1.1.2 Site Description

The Removal Action involves the demolition and proper disposal of approximately 40 - 60 abandoned buildings suspected to contain asbestos and/or lead-based paint. The buildings are generally structurally unsound with insulation, roofing and floor materials released at the Site. The buildings were identified by the Region 8 Brownfields Program and the Oglala Sioux Tribe’s Environmental Protection Program as safety concerns and suspected sources of asbestos and lead-based paint exposure to nearby residents.  Since the Action Memorandum was written the OST has requested additional properties be addressed.  Some of these were the result of a severe wind storm on July 28, 2012, that heavily damaged many structures.  The current tally of properties to be addressed is 87.

1.1.2.1 Location

The Site is located on the Pine Ridge Indian Reservation in East Shannon, Jackson and Bennett counties, in southern South Dakota. The Pine Ridge Indian Reservation is approximately 3,500 square miles or 2.2 million acres. The  abandoned or damaged structures include both residential and commercial properties and are dispersed throughout the Site boundaries. The majority of buildings, however, are located in the Pine Ridge/Oglala area.

1.1.2.2 Description of Threat

The known contaminants of concern are asbestos and lead. In addition, two homes are a suspected source of hanta virus. These are hazardous substances as defined by Section 101 (14) of CERCLA. There are also an unknown number of abandoned containers that may also contain hazardous substances and/or pollutants or contaminants.

1.1.3 Preliminary Removal Assessment/Removal Site Inspection Results

Between April 2008 and March 2012, the Oglala Sioux Tribe’s Environmental Protection Program completed environmental assessments and field inspections of approximately 40 – 60 buildings located on the Pine Ridge Indian Reservation. In general, the buildings were determined to be unsecured, abandoned, structurally unsound and unsafe. Several of the buildings include improperly disposed and abandoned trash and unknown containers. According to the Oglala Sioux Tribe’s field inspection reports and documented photos, children play in the abandoned buildings, tearing out insulation and further releasing debris into the environment. The Tribe hired RESPEC Consulting and Services who reviewed the field inspection reports and identified the sites as suspect for asbestos containing materials in floor tiles, insulation, and roofing materials and/or lead-based paint.

On April 24, 2012, the Oglala Sioux Tribe’s Environmental Protection Program provided the field inspection reports to EPA Region 8’s Brownfields Program and requested assistance from the EPA Emergency Response Unit in demolishing the abandoned buildings and properly disposing of the potential asbestos and lead contaminated materials, abandoned trash, and unknown containers. Given the hazards present at the Site and the proximity to community residences and children, EPA is conducting a Time-Critical Removal Action at the Site utilizing EPA’s emergency response contractors.  

EPA conducted a removal site assessment June 25-29, 2012, to confirm building locations and identify any potential issues to consider in planning the Removal Action.  At this time 32 properties were designated as definate cleanup targets, with another 19 needing further evaluation.

2. Current Activities

2.1.2 Response Actions to Date

EPA mobilized to Pine Ridge on July 9, 2012. Landfill preparation began on July 10, 2012. Demolition of the structures began July 12, 2012. Demolition and/or clean up has been completed at 66 properties. Demolition and/or cleanup is in progress on four properties.  This work includes all of the properties refered to EPA by the OST in and around the town of Red Shirt, SD.  The OST has referred additional properties to the EPA, bringing the current total of properties to be addressed to 87.  The waste is being transferred and properly disposed of at the Pine Ridge Reservation Landfill. 

At the Pine Ridge Landfill EPA has constructed a separate disposal area for the debris from the on-going cleanups.  Waste is covered contemperaneously with its disposal.  As of August 15, 2012, a total of 322 loads  (approximately 35 cubic yards each) have been sent to the landfill.

  2.2 Planning Section
    2.2.1 Anticipated Activities

2.2.1.1 Planned Response Activities

Work will continue over the next week in the Pine Ridge/Oglala area.  Originally it was planned to move cleanup crews to the eastern side of the Reservation, in and around the town of Wanblee, SD, the week of August 6.   However, due to the number of properties on the western side of the Reservation needing to be addressed, this is now planned for the week of August 20.  As of COB on August 15,  2012,10 properties in the Pine Ridge/Oglala remained to be addressed.  There are 10 properties to be cleaned up in and around the town of Wanblee, 1 near Manderson, SD, and one near Allen, SD.

EPA will continue with preparation and management of an area within the existing cell at the local Pine Ridge landfill to receive the contaminated waste.
 
2.2.1.2 Next Steps

EPA will continue with demolition activities on structures on the western portion of the Pine Ridge Reservation..  It is anticipated that work will start in Wanblee, SD, by August 22, 2012.

2.2.2 Issues

Given the large extent of the Site and the long distances between the landfill and the structures, transportation and logistics are key issues.  Fuel expenditures are over $1,500 per day.
