1.1.2 Site Description


1.1.2.1 Location

The Site is located at 170 E 131st St, Cleveland, Cuyahoga County, OH.  The Site is located in an industrial/commercial/warehouse area in Cleveland, Cuyahoga County, Ohio.  The Site is bordered to the north by Kirby Avenue, Coit Road, and industrial properties; to the east by E 131st Street and industrial properties; to the south by Pull A Part, and to the west by Kirby Avenue and industrial properties.

1.1.2.2 Description of Threat

A tenant filled the Site building with municipal waste.  Upon notification that the municipal waste had to be removed from the building, the tenant and/or the tenant’s contractors began demolishing the building to access and remove the waste.  No demolition permit was granted prior to the start of demolition activities at the Site.  In addition, there is no evidence that asbestos abatement activities were conducted prior to the start of demolition activities at the Site.  On August 17, 2012, the Ohio EPA collected bulk material samples from the demolition debris piles, which indicated asbestos-containing materials (ACM) are present in the debris piles at concentrations up to 65% Chrysotile, 20% Amosite, and 10% Crocidolite.  The main concern is that the ACM is friable and asbestos fibers are being released into the air and possibly migrating off site.  Another concern is that trespassers onto the Site will come into contact with the ACM, disturb the materials, and cause further releases into the air.

1.1.3 Preliminary Removal Assessment/Removal Site Inspection Results

On August 17, 2012, the Ohio EPA collected 13 bulk samples from suspect asbestos materials in the building and within demolition debris piles.  The samples were analyzed for friable asbestos in accordance with EPA 600/R-93/116 Method using Polarized Light Microscopy.  Analytical results for 10 of the 13 samples confirmed the presence of high levels of ACM in TSI and in debris piles at concentrations up to 65% Chrysotile, 20% Amosite, and 10% Crocidolite. 

On August 30, 2012, the Commissioner of Air Quality of the City of Cleveland, Department of Health issued a Sealing Order for the property.  The Sealing Order prohibited entry and occupation of the property by any party other than officials from the EPA, Ohio EPA, and the City of Cleveland.

On August 31st and September 1st, 2012, EPA mobilized its START and ERRS contractors to secure the perimeter of the property from trespass and collect perimeter air samples to determine if asbestos fibers were being released off Site.  The ERRS contractor repaired or replaced sections of fencing and secured man-doors and windows.  No Trespassing and asbestos warning signs were placed around the property.  The START contractor collected 2 rounds of perimeter air samples.  All analytical results were non-detect for asbestos fibers.  As these initial response actions were completed, EPA coordinated with the City regarding enforcement actions.  EPA and the City agreed that the City would continue to pursue legal actions to compel compliance from the responsible parties.


2. Current Activities
  2.1 Operations Section
    2.1.1 Narrative

As a result of the potential for airborne asbestos fibers to migrate off site, the City of Cleveland referred the Site to the U.S. EPA.  The City of Cleveland Commissioner of Air Quality placed a Sealing Order on the Site prohibiting the entry onto the Site or occupancy of the Site by unauthorized persons.  On August 31, 2012, U.S. EPA mobilized its ERRS and START contractors to the Site to conduct emergency response activities, including perimeter air sampling for asbestos and securing the perimeter of the Site from unauthorized entry.

2.1.2 Response Actions to Date

On August 31, 2012 START mobilized to the Site to conduct perimeter air sampling for asbestos in order to determine the threat of exposure to the surrounding community.  ERRS mobilized to the Site to secure the Site perimeter.  ERRS repaired sections of broken perimeter fencing, secured gates in the perimeter fencing, install new perimeter fencing where needed, secured exterior doors leading into the Site building, and temporarily repaired a portion of the exterior building wall along Kirby Avenue.

On September 1, 2012 START mobilized to the site to conduct a second round of perimeter air sampling for asbestos. START collected perimeter air samples from the same three (3) locations as August 31, 2012, along with a fourth location.  The fourth location was located near the center of the Site between portions of the standing building walls and piles of municipal waste. 

Site operations were suspended allowing for the City to complete legal actions against the PRPs.  The City has not been successful in compelling the PRPs to undertake a clean up on the site.  

On Wednesday, July 17, 2013, EPA, ERRS and START mobilized to the site to begin a Fund-lead removal action.  General clean up of the support zone began.

On Thursday, July 18th, support zone setup continued.  Heavy equipment was delivered to the site.  ERRS began stock piling municipal waste for off site disposal.  Waste was consolidated into a large pile to make room for future site work.  Site decontamination zone was established.

On Friday, July 19th, municipal waste was loaded for off site disposal at American Landfill, Waynesburg, OH.  Approximately 235 tons of municipal waste was transported off site.  START began site air sampling and documentation.  Site setup continued.  Site trailers delivered to the site.

On Monday, July 22nd,  ERRS continued to to load municipal waste to American Landfill.  Approximately 329 tons was transported off site.  ERRS continued to push waste into stock pile for off site shipment.  Site generators delivered to the site.  ERRS crew began cleaning asbestos off floors within the building and bagging thermal system insulation (TSI) for off site disposal.

Tuesday, July 23rd,  ERRS continued to to load municipal waste to American Landfill. Approximately 406 tons was transported off site. ERRS crew continues cleaning asbestos off floors within the building.

Wednesday, July 24th, ERRS continued to to load municipal waste to American Landfill. Approximately 270 tons was transported off site. ERRS crew continues cleaning asbestos off floors within the building.

Thursday, July 25th, ERRS continued to to load municipal waste to American Landfill. Tonnage not available at the time of this report. ERRS crew continues cleaning asbestos off floors within the building.

START continues to conduct daily air sampling on site.

2.1.3 Enforcement Activities, Identity of Potentially Responsible Parties (PRPs)

The property owner on record is Acme Reality, LLC.  EPA issued a UAO to PRPs on June 28, 2013.  No RP has responded to, or complied with, the UAO.

Continue to ship municipal waste off site to clear space to stage waste from inside the building.  Waste will need to be moved from inside the building and restaged outside in order to abate deteriorated TSI on pipes exposed to the elements.

Begin shipping asbestos contaminated C&D off site.

Begin staging asbestos contaminated municipal waste from inside the building for off site disposal.
