1.1.1 Incident Category
1.1.2 Site Description
1.1.2.1 Site Location
The West Songbird Road Site presently consists of approximately 8.5 acres of land located within a tract, identified as Parcel No. 17-008-100-00 in the McKean County Property Records, located near West Songbird Road in Bradford Township, McKean County, Pennsylvania. The Site is located at the geographical coordinates, 41.905470 degrees latitude and - 78.68.88344 degrees longitude.
1.1.2.2 Description of Threat
The EPA OSC initiated an initial site inspection and removal assessment on September 27, 2010 in response to a request by the Bradford Police Department. The assessment identified suspected asbestos-containing material (ACM) both inside and outsde of two abandoned, deteriorated on-site buildings. The buildings contained various types of debris including old boxes of block insulation and deteriorated pipe insultation. In addition, a leaking 35-gallon drum of an unknown green liquid was observed in one of the buildings. A pile of weatered, deteriorated pipe insulation was observed near an open dumpster located outside the buildings. The dumpster contained broken pieces of block insulation similar to what was observed inside the buildings.
At the time of the initial assessment, the suspected ACM was observed to be in a deteriorating condition. The leaking drum was found to be exposed to the weather and given its condition is likely to continue to leak its contents until stabilized or contained.
Access to the exterior and interior of the buildings is not restricted. Children and/or teens can easily access the property. EPA observed evidence of trespassers, paintball, bonfires, and all-terain vehicle activities at the Site.
1.1.3 Preliminary Removal Assessment/Removal Site Inspection Results
On October 21, 2010, EPA and its contractor, TechLaw, Inc.'s (TechLaw) Superfund Technical Assessment and Response Team (START) conducted sampling to further assess the West Songbird Road Site. A total of seven samples were collected from suspected ACM material (block insulation, pipe insulation and drywall material) from inside and outside of the buildings. The samples were analyzed for asbestos fibers. The analytical results indicated that six out of the seven samples contained asbestos fibers greater than 2%. Of the nine asbestos species analyzed for, the six samples contained two species. Chrysotile fibers were found in the range of 8-10% and amosite fibers were found in the range of 2-5%. Asbestos is a hazardous substance within the meaning of CERCLA, as it is listed in Section 302.4 of the NCP.
The analytical results from the sample collected from the leaking drum confirmed the presence of di-n-butylphthalate (CAS#84-74-2) as a concentration of 790 ug/kg. Di-n-butylphthalate is a hazardous substance within the meaning of CERCLA, as it is listed in Section 302.4 of the NCP.

2.1.1 Narrative
2.1.2 Response Actions to Date
The PRP contractors began to mobilize equipment, labor and materials to the site on November 2, 2011. Asbestos abatement activities began on November 7, 2011 after a 10 day asbestos notification to the Pennsylvania Department of Environmental Protection and USEPA had passed. The abatement and off-site disposal of asbestos containing materials (ACM's) was completed on November 16, 2011. A 35 gallon fiber drum containing an acidic liquid, and associated stained soils and debrs were transported from the site for disposal on November 22, 2011. A post-response action project closeout meeting at the site was attended by the PRP's and their contractors and the USEPA On-Scene Coordinator on November 29, 2011. During this meeting the response action activities were reviewed and completion of tasks verified. A final report was submitted by the PRP's on May 4, 2012.
2.1.3 Enforcement Activities, Identity of Potentially Responsible Parties (PRPs)
Two PRPs have been identified with respect to their current ownership of the property. In separate letters, each dated May 9, 2011, EPA contacted the PRPs regarding there potential liability under Section 107(a) of the CERCLA, as amended. The letters, which included draft settlement agreements, invited the PRPs to perform certain response activities to address asbestos and other hazardous substances found at the Site.
The PRPs have agreed to conduct the work necesary to clean up the ACM at the site. An Adminstrative Settlement and Order on Consent (AOC) for removal response action between EPA and the PRPs became effective on September 27, 2011.
