1.1.2 Site Description


1.1.2.1 Location

The Site is located at 170 E 131st St, Cleveland, Cuyahoga County, OH.  The Site is located in an industrial/commercial/warehouse area in Cleveland, Cuyahoga County, Ohio.  The Site is bordered to the north by Kirby Avenue, Coit Road, and industrial properties; to the east by E 131st Street and industrial properties; to the south by Pull A Part, and to the west by Kirby Avenue and industrial properties.

1.1.2.2 Description of Threat

A tenant filled the Site building with municipal waste.  Upon notification that the municipal waste had to be removed from the building, the tenant and/or the tenant’s contractors began demolishing the building to access and remove the waste.  No demolition permit was granted prior to the start of demolition activities at the Site.  In addition, there is no evidence that asbestos abatement activities were conducted prior to the start of demolition activities at the Site.  On August 17, 2012, the Ohio EPA collected bulk material samples from the demolition debris piles, which indicated asbestos-containing materials (ACM) are present in the debris piles at concentrations up to 65% Chrysotile, 20% Amosite, and 10% Crocidolite.  The main concern is that the ACM is friable and asbestos fibers are being released into the air and possibly migrating off site.  Another concern is that trespassers onto the Site will come into contact with the ACM, disturb the materials, and cause further releases into the air.

2. Current Activities
  2.1 Operations Section
    2.1.1 Narrative

As a result of the potential for airborne asbestos fibers to migrate off site, the City of Cleveland referred the Site to the U.S. EPA.  The City of Cleveland Commissioner of Air Quality placed a Sealing Order on the Site prohibiting the entry onto the Site or occupancy of the Site by unauthorized persons.  On August 31, 2012, U.S. EPA mobilized its ERRS and START contractors to the Site to conduct emergency response activities, including perimeter air sampling for asbestos and securing the perimeter of the Site from unauthorized entry.

The Responsible Parties failed to comply with numerous Court Orders from the City of Cleveland to address contamination on the property.  EPA issued a Unilateral Order to the PRPs on June 28, 2013.  PRPs failed to respond to the UAO and have not complied with the Order.

2.1.2 Response Actions to Date

On Friday, July 26th, municipal waste was loaded for off site disposal at American Landfill, Waynesburg, OH.  Approximately 308 tons of municipal waste was transported off site.  ERRS crew continues cleaning asbestos TSI off floors within the building.  START identified labels on various containers and tubes of caulk within the building, will obtain MSDS sheets per OSC request.
 
On Monday, July 29th,  ERRS continued to load municipal waste to American Landfill.  Approximately 315 tons was transported off site. ERRS crew continues cleaning asbestos TSI off floors within the building.  Scissor lift arrives on-site.

On Tuesday, July 30th,  ERRS continued to load municipal waste to American Landfill. Approximately 378 tons was transported off site. ERRS crew continues cleaning asbestos TSI off floors within the building. ERRS crews begin removing deteriorated asbestos TSI from overhead piping using scissor lift. Mercury beads were discovered in a room expected to be associated with the facility boiler room.  Area was assessed with a Lumex.

On Wednesday, July 31st, results from bulk samples collected by START documented non-friable asbestos in C&D waste pile. Material will be shipped off-site as C&D with non-friable asbestos.  ERRS continued to load C&D with non-friable asbestos to American Landfill. Approximately 270 tons was transported off site. ERRS crew continues cleaning asbestos TSI off floors within the building.  ERRS crews continued removing detriorated asbestos TSI from overhead piping.

On Thursday, August 1st, ERRS continued to load C&D with non-friable asbestos to American Landfill. Approximately 200 tons was transported off site. ERRS crew continues cleaning asbestos TSI off floors within the building. ERRS crews continued removing asbestos TSI from overhead piping.

On Friday, August 2nd, ERRS continued to load C&D with non-friable asbestos to American Landfill. Approximately 137 tons was transported off site. ERRS crew continues cleaning asbestos TSI off floors within the building. ERRS crews continued removing asbestos TSI from overhead piping. START screened area with mercury beads with Lumex. 

On Monday, August 5th, ERRS crews continued cleaning asbestos TSI off floors within buildings and placing asbestos bags in roll off box for off-site disposal.  ERRS crews continued removing asbestos TSI from overhead piping. Asbestos consultants on site for asbestos survey of building.

On Tuesday, August 6th, ERRS began to demo a collapsed portion of the building along Kirby Rd.  ERRS crews continued cleaning asbestos TSI off floors within buildings and placing asbestos bags in roll off box for off-site disposal. ERRS crews continued removing asbestos TSI from overhead piping. Asbestos consultants on site for asbestos survey of building.  ERRS begins mercury clean up using a mercury vac in a room at south end of building where mercury was discovered.

On Wednesday, August 7th, ERRS demoed the collapsed saw tooth portion of the building sitting on top of municipal waste. ERRS crews continued cleaning asbestos TSI off floors within the building and removing asbestos TSI from overhead piping.  ERRS continued mercury clean up.  Asbestos consultants on site for asbestos survey of building. ERRS continues to consolidate C&D with non-friable asbestos and municipal solid waste with friable asbestos in separate piles.

On Thursday, August 8th, ERRS crews continued cleaning asbestos TSI off floors within the building and removing asbestos TSI from overhead piping. ERRS continued mercury clean up.  Asbestos consultants finished asbestos survey. ERRS loaded scrap metal boxes for off-site disposal.  ERRS continues to consolidate C&D with non-friable asbestos and municipal solid waste with friable asbestos in separate piles.   

START continues to conduct daily air sampling on site.

2.1.3 Enforcement Activities, Identity of Potentially Responsible Parties (PRPs)

The property owner on record is Acme Reality, LLC.  EPA issued a UAO to PRPs on June 28, 2013.  No RP has responded to, or complied with, the UAO.
 
2.1.4 Progress Metrics

As of July 30, 2013, approximately 2,606 tons of municipal waste shipped off site

As of August 2, 2013, approximately 607 tons of C&D with non-friable asbestos shipped off site

As of August 8, 2013, 1, 20 cu. yd. roll-off dumpster with asbestos TSI bags shipped off site

As of August 8, 2013, 32.53 tons of scrap steel recycled.  Recycle value of $7,925.87 retuned to the Site removal account.
