The removal action was completed as of today November 13, 2013.
The last drop box containing contaminated soil was removed from the site for disposal.  
Results from the confirmation sample REX-16, from area of burned debris, were received.  The sample indicated elevated lead (1060mg/kg).

 

2.1.3 Enforcement Activities, Identity of Potentially Responsible Parties (PRPs)
A PRP has been identified and is conducting removal action under the oversight of the United States Environmental Protection Agency and in accordance with an Administrative Settlement Agreement and Order on Consent pursuant to the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). The PRP has contracted Apex Companies, LLC. to design and implement the removal activities.

Decide if further action will be necessary based on the results from the risk assessment.

The one-year monitoring and maintenance inspections will be reviewed by EPA. After completion of the one-year monitoring and maintenance, EPA will reassess the situation to determine whether any continuing Long Term Post Removal Site Controls will be necessary.

ODEQ support to conduct the Long Term Post Removal Site Control or the one-year monitoring and maintenance inspections will not be used. This decision was reached after reviewing the AOC, and the requirements of Section 300.415 (l) of the NCP. It seems that there is no legal requirement to conduct Post Removal Site Control.

The OSC is currently coordinating with the EPA Region-10 Office of Environmental Assessment, to determine if the burned area where the confirmation sample (REX-16) was high on Lead requires further action.
