Active Oil Production Facility
1.1.2 Site Description
The site is an oil production facility tank battery, flow line and impacted sections of the Arnett Branch Creek. The tank battery consists of three above ground storage (AST) tanks and associated pumps and piping.
1.1.2.1 Location
The street address for tank battery is 129 Jim Arnett Branch Road, Salyersville, Magoffin County, Kentucky. The site coordinates are 37.704944, -83.007946. The break in the flow line occurred approximately 200 feet east of the tank battery. The facility is located in a residential area of Magoffin County. The tank battery is located directly adjacent to private homes.
1.1.2.2 Description of Threat
Small creeks, tributaries and wetland are located down gradient of the tank battery and flow generally East and Northeast away from the site. A discharge of oil has occurred to waters of the United States requiring immediate response actions. The oil discharged to the Arnett Branch which is a tributary of Licking River, which leads to the Ohio River.
1.1.3 Preliminary Removal Assessment/Removal Site Inspection Results
Break occurred along a flow line located about 200 feet down gradient of the tank battery. Between 5 and 10 barrels of oil were discharged into approximately 0.25 miles of Arnett Branch. The spill source has been stopped and down gradient migration is currently being contained.

2. Current Activities

2.1 Operations Section
|
|
|
|
2.1.1 Narrative
Kentucky Department of Environmental Protection (KYDEP) responded to a report of an oil spill. The exact amount of oil spilled is unknown, but 0.25 miles of the Arnett Branch Creek is impacted. The source of the spill was identified as a flow line. KYDEP was issued a Pollution Response Funding Authorization (PRFA) to begin cleanup operations on January 13, 2015. On the afternoon of the January 13, 2015 the flow line was traced back to a operational production facility. The operators stated the flow lines are not theirs and will not conduct the cleanup. On-Scene Coordinator (OSC) Eichinger was deployed to confirm flow line ownership and ensure PRP response actions occur.
2.1.2 Response Actions to Date
OSC Eichinger arrived onsite the morning of January 14, 2015 and met with KYDEP State OSC's. KYDEP implement cleanup operations on January 13, 2015 using absorbent booms, absorbent pads, vacuum trucks and leaf blowers. The majority of recoverable crude oil had been collected by the evening of January 14, 2015.
OSC Eichinger confirmed that the flow line was part of the Boone Oil Production Facility. At 1246 hours, OSC Eichinger contacted the PRP Representative over the phone after multiple fail attempts. No other authorized representatives were onsite. OSC Eichinger issued a verbal notice of federal interest. OSC Eichinger and State OSC Stidham had a conference call with the PRP Representative at 1339 hours and requested the PRP take responsibility for the costs of the cleanup and enter into a contract with PECCO Environmental. The PRP Representative stated he would attempt to pay for the cleanup costs but indicated that the company may not be able to cover the costs.
KYDEP will work with the PRP to develop and implement a maintenance and operations plan to recover residual spilled crude oil and continue to provide oversight and response operations under the PRFA issued through EPA.
2.1.3 Enforcement Activities, Identity of Potentially Responsible Parties (PRPs)
A Notice of Federal Interest was issued verbally to the RP representative and was followed up by a written Notice of Federal Interest sent by certified mail. The RP representative is not local. The PRP for this incident is:

EPA and KYDEP spoke with the owner over the phone and discussed the response. KYDEP will provide oversight to assure the cleanup plan is implement appropriately and cleanup goals are met.
