1.1.1 Incident Category

1.1.2 Site Description
On 6 August 2015, a tanker trailer carrying a mixture of off-road (red-dye) diesel and gasoline on Highway 12, near Orofino, Idaho, became unstable and flipped over and ruptured two of its three tanks. The spill volume of mixed fuels off-road diesel and gasoline is approximately 1900 gallons, which has seeped into the overburden road shoulder material in the east side (river side) and to a lesser extent into the west side shoulder and drainage ditch.  The spill site is directly adjacent to the Clearwater River, located approximately 20 to 25 feet from the east side of the highway and is approximately 25 to 30 feet lower in elevation.

1.1.2.1 Location
Approximately Mile Post 62.5, US Route 12, Lewis County, Idaho, on the Nez Perce Indian Reservation

1.1.2.2 Description of Threat
1900 gallons of diesel and gasoline were spilled adjacent to the Clearwater River, which has seeped into the overburden road shoulder material in the east side (river side) and to a lesser extent into the west side shoulder and drainage ditch.  The Clearwater River empties into the Snake River approximately 60 miles downstream of the spill, and the Snake River ultimately flows into the Columbia River A sheen was observed on the Clearwater River on the day of the spill.  It is anticipated that spilled diesel and gasoline will travel toward the River and thus, OSCs Liverman and Zavala have determined that the spill represents a substantial threat of discharge.

1.1.3 Preliminary Removal Assessment/Removal Site Inspection Results

Based on direct observations of the spill, nearly all of the 1900 gallons of diesel and gasoline seeped into the road shoulder material on either side of the road or directly into the road bed.  Within a matter of a few hours, a sheen was seen discharging into the river from the river bank directly adjacent to the spill location.  No physical assessment has been conducted due to the need to maintain road integrity, while a cleanup plan is being developed and approved by EPA.    

2. Current Activities
  2.1 Operations Section
    2.1.1 Narrative
OSC Liverman and OSC Zavala responded from Coeur d'Alene and Seattle offices respectively on 8/07/2015 after receiving report of the spill from the National Response Center (NRC) and having a bridge call with Idaho State Communications. 

The PDO, Follow, notified the Department of the Interior, who offered to notify the USFWS regarding Endangered Species Act Section 7 concerns.  No endangered or threatened species have been identified so far. 
Mr. Follow also notified the Nez Perce Tribe regarding National Historic Preservation Act concerns. A tribe representative visited the site and informed the RP that they have no concerns but, they are planning to be at the site at the time of the excavation.

At approximately 9:45 am on Friday August 07 2015, EPA OSCs, along with representatives from the Idaho Department of Environmental Quality, Idaho Department of Transportation, Idaho Department of Lands, Idaho State Police, Lewis County Sheriff, and a representative of Atkinson Distributing, Inc. (Responsible Party (RP)) and RP's contractor met on-site and began planning for the cleanup action.  Leading the meeting, EPA OSC Liverman explained to the RP EPA's expectations as far as cleanup actions and summarize the permits and coordination that needed to happen before starting any major work at the site such as excavation.  He explained the need to contracting and environmental contractor and submitting the work plan.  The RP agreed to have a work plan ready for review and comments by Wednesday, 08/12/2015. EPA OSC Liverman and Zavala stayed on site for a couple of hours to talk about the cleanup efforts approach, then they demobilized.

On 8/11/2015: OSC Zavala faxed Mr. Jeff Adams, Atkinson Distribution, Inc., a Notice of Federal Interest, and requested that he sign and email it back to her. 

On 8/12/2015:  A cleanup Work Plan was submitted, but was deemed incomplete by EPA OSC Liverman.  OSC Liverman then held a meeting at the Lewiston IDEQ office with IDEQ, ITD, Lewiston County representatives, and the RP and RP contractors to inform them was unacceptable due to the lack of Health and Safety Plan, Site Specific Sampling Plan, Quality Assurance Plan, Traffic Control Plan, Decontamination Plan, Waste Disposal Plan, BMPs in place, etc. The OSC stopped all major work, such as excavation, due to safety concerns. However, the RP was advised to continue the maintenance of the boom already deployed. At the meeting, it was decided, by the present agencies, to give the RP a second chance to submit an adequate work plan since then RP informed him that he had an environmental contractor, Tetra Tech, working on it already.  The due day was extended to Friday, 8/14/2015 at which time the Unified command would review and provide comments and then OSC Zavala would determine if the cleanup effort would need to be federalized.

The Work Plan was submitted to OSC Zavala, and IDEQ, Nez Perce Tribe, ITT representatives on the accorded day 8/14/2015 for review and comments.  The team had a conference call on 8/17/2015 to discuss the work plan. During the conference call, it was decided not to approve the plan until a few items were addressed. The RP was given until 8/18/15 5:00pm to submit the Work Plan.

The RP submitted the Work Plan on the accorded day and the Unified Command reviewed it and had a conference call on the following day to discuss it.  The requested changes were made and the team agreed to approve the Work plan.  OSC Zavala informed the RP that the Work Plan was approved.  However, she told him that they couldn’t start the removal actions until information from IDL regarding the nearby fires indicated that the fires didn’t represent safety concerns. 

On Thursday August 20th, after coordinating with IDL, OSC Zavala agreed with the RP and RP’s contractor to start removal operations on Monday August the 24th at 7:00 am pending on changes on the information from IDL.

After continuous coordination over the weekend with the Operation Section Chief and the Incident Command working on the fires around the site, on Sunday morning OSC Zavala received an email from the Idaho Department of Land informing her that the excavation on US Route 12 won't interfere with their operations and didn't present any safety or access concerns anymore.

2.1.2 Response Actions to Date
Immediate emergency response was conducted by locals authorities and the RP.  Boom and fuel oil absorbent pads were deployed. Fuel oil collection on the boom has been minimal and minor quantities of oil has been accumulating on the absorbent of the pads. Boom maintenance is ongoing.  Action Environmental Group reported that approximately 84 yards of impacted soil was scraped to a depth ranging between 12 to 24 inches and restored in anticipation of using the western shoulder as an alternating (one way) detour lane while major soil removal is conducted. The soil was disposed at Jacksons Land Farm and soil samples were collected. 

The RP have been sending reports of work performed at the site on a regular basis to OSC Zavala.   The work performed at the site consist of replacing some spill pads that had a small amount of product on them, adding containment booms to the outside of the booms that were already in place (about 40 foot booms, to act as a secondary containment in case something were to get outside the original sets of booms and spill area), adding silt fence, etc.

The RP has failed to provide an acceptable work plan on two instances and there was a poor coordination at the site for about a week. In addition, although the RP and its contractors were ready to start excavation, work didn't start until the Idaho Department of Land communicated to OSC Zavala that excavation on US Route 12 won't interfere with their fire operations and didn't present any safety or access concerns anymore.
