2.1.2 Response Actions to Date

8/24/2015 to 8/25/2015

1. EPA and RP and RP’s contractors attended the daily 0700 Site briefing and safety meeting;
2. Traffic control is occurring 24/7;
3. The West end of the east bound of the bypass lane was filled and compacted at a length of about25', which extended the bypass lane to help with traffic control;
4. Traffic was then diverted into the bypass lane, and put a load of gravel on the west bound lane for the excavator PC600 to set on to minimize damage to the highway from the tracks; 
5. The PC 600 was set on the west bond lane via lowboy truck, and unloaded it on the gravel;
6. Excavation started at the toe of the bank; 
7. Dust suppression was ongoing;
8. Samples were taken from the stockpile to document the concentrations of diesel constituents in the soil disposed/recycled at the Jackson landfarm. Samples were sent to Anatek labs the following day.  

August 26, 2015 

1. EPA, RP and RP’s contractors attended the daily 0700 Site briefing and safety meeting;
2. Traffic control set up 24/7; flaggers during the day and portable traffic lights from 7:00pm to 7:00am
3. The silt fence was re-anchored to the base material. Two 10 inch straw wattles were placed just up the bank from the silt fence along the entire area excavated immediate adjacent to the river;
4. Large rocks that can be used to restore the riverbank and slope to near pre-spill conditions are being moved to the sides of the excavation area.;
5. Two trenches were dug on the upriver side of the impacted area;
6. Four closure samples were collected from the base of the most upriver trench. Three samples were collected from the sidewall of the upriver trench. Three closure samples were collected from the base of a second trench dug next to the first trench.
7. Due to the slope stability concerns, the lower part of the trench was backfilled before excavating the upper area.  The areas were backfilled with 4 inch minus pit run to stabilize the slope; as backfilling, the material was compacted four times 12 to 18 inches per lift.
8.  Bob Rees from NOAA Fisheries contacted OSC Zavala regarding her message about ESA Section 7 concerns.  He told her that endangered species (upper river salmon) migration doesn’t start until later next month.  He said that the precaution taken to prevent sedimentation going into the Clearwater river were pretty much what he would recommend.  

August 27, 2015

1. EPA, RP and RP’s contractors attended the daily 0700 Site briefing and safety meeting;
2. Traffic control set up 24hrs; flaggers during the day and portable traffic lights from 7:00pm to 7:00am;
3. One trench was dug on the upriver side of the impacted area. One base confirmation sample was collected from the top area of the trench (lower base confirmation samples were collected yesterday). Due to the slope stability concerns, we backfilled the entire trench before excavating another trench. The area was backfilled with 4 inch minus pit run to stabilize the slope; the backfill material was compacted to IDT requirements;
4. Another trench was excavated on the downstream side of the original exploratory trench. Bedrock was encountered at the toe of this trench and collected closure samples there. Excavation continued further up the slope and collected another base sample approximately 10 feet above the toe sample where bedrock was also encountered. Due to the slope stability concerns, the base of this trench was backfilled and compacted;
5. Water to control dust was used throughout the day to minimize dust in the temporary traffic lane.

8/28/15 to 8/29/15

1. EPA, RP and RP’s contractors attended the daily 0700 Site briefing and safety meeting;
2. Traffic control set up 24hrs; flaggers during the day and portable traffic lights from 7:00pm to 7:00am;
3. Water to control dust was used throughout the day to minimize dust in the temporary traffic lane;
4. Due to several fires in the area, smoke was pretty heavy and OSC Zavala suggested to the RP contractor to have filtered facepiece respirators for the crew to use.  The contractor made the respirators available.
5. Excavation of contaminated soil, following the same protocol as previous days, continued until reading of the FID showed less than 200 mg/kg, as the Work Plan called for.  Confirmation were taken according to the Work Plan as well.
6. All impacted soil was excavated by the end of the day, backfilled and compacted;
7. The road was cleaned and the excess backfill material was taken to be storage in case it was needed later;
8. The area is ready to start the application of the gravel, compaction, and paving;
9. A question was raised:  is it necessary to conduct more cleanup in the West bond of the road?  this matter will be discuss on the meeting arrange for Monday morning;
10. OSC Zavala, RP, and RP contractor demobilized and are coming back on Monday to continue operations. Site meeting was held to discuss the Scope of Work for Sunday, August 30, 2015.  During that meeting, it was determined that additional work at the site could not be conducted until Monday August 31, 2015.  This was the result of the forecast of rain, the unavailability of an erosion control mat, the lack of a compaction proctor of the asphalt base coarse, and needed guidance from Idaho Transportation Department in regard to road and shoulder replacement.
    

2.1.3 Enforcement Activities, Identity of Responsible Parties (RPs)
Jeff Adams identified himself as the RP for Atkinson Distribution, Inc. Atkinson is the trucking company that owns the truck that went off the road.
