Hurricane Dorian Response


EPA Region 4 has redeployed one water sector liaison (ESF-3) from the Florida EOC to the North Carolina EOC. The Florida Department of Environmental Protection is beginning status checks to hazardous waste facilities in the southern portion of the state and expects to initiate outreach to the mid to northeast portions of the state either today or tomorrow. Additionally, two EPA personnel deployed today to provide direct oil and hazardous substance support (ESF-10) to North Carolina and one remains in South Carolina. To date, EPA has issued fuel waivers to Florida which remain in effect until September 15th and a total of six No Action Assurances to the impacted states. EPA has temporarily suspended operations at one NPL site in North Carolina and one emergency response site in South Carolina to ensure worker safety. As the path of the storm continues to evolve, we will continue to monitor our sites.

EPA’s headquarters EOC is on Enhanced Watch to monitor the storm and coordinate with impacted regions. In addition, the EOC is also monitoring developments in the Bahamas in anticipation of a potential request for international assistance. The EPA Region 4 Regional Emergency Operations Center (REOC) is activated to Level 2 and is monitoring the storm as it moves over the Atlantic coast. EPA Enforcement Actions


Florida

  • On August 30, 2019, EPA issued a new emergency waiver of the Reid Vapor Pressure (RVP) requirements and Reformulated Gasoline (RFG) commingling prohibitions for the State of Florida.

  • On August 30, 2019, EPA issued a new emergency waiver to allow the use of red dyed 15 parts per million sulfur non-road locomotive and marine diesel fuel in diesel-powered highway vehicles in the State of Florida.

  • Related IRS Waiver: On August 30, 2019, the IRS waived tax penalties when dyed diesel fuel is sold and used for highway use in the State of Florida.

  • On August 30, 2019, EPA issued a No Action Assurance (NAA) letter to Florida regarding the loading of tanker fuel trucks at petroleum distribution terminals.

  • On August 30, 2019, EPA issued an NAA letter to Florida regarding the use of vapor recovery systems at bulk gasoline loading terminals and truck loading racks.

  • On September 2, 2019, EPA issued an NAA letter to Florida regarding certain actions in connection with the operation of the Treasure Coast Energy Center (St. Lucie Co.).

Georgia

  • On September 2, 2019, EPA issued an NAA letter to Georgia regarding the loading of tanker fuel trucks at petroleum distribution terminals.

South Carolina

  • On September 2, 2019, EPA issued an NAA letter to South Carolina regarding the loading of tanker fuel trucks at petroleum distribution terminals.

North Carolina

  • On September 3, 2019, EPA issued an NAA letter to North Carolina regarding the loading of tanker fuel trucks at petroleum distribution terminals


All fuel waivers and NAAs are effective through September 15, 2019
