On April 18, 2008, OSC Smith initiated a time-critical removal action at the site of an abandoned oil refinery. The objective is to prevent oily leachate exiting a spring from entering the North Fork of Elkhorn Creek. EPA was notified by the Kentucky Department for Environmental Protection (KDEP) of a complaint filed on 04/12/08 by a canoeist regarding this discharge. EPA mobilized ERRS contractor CMC, Inc. on 04/18 to contain the discharge at the spring and containment was deemed to be effective by 04/19. The water is being collected, filtered to remove visible solids, and discharged onsite, pending receipt of analytical results.

The site is the subject of ongoing negotiations for a time-critical removal action and a RI/FS between EPA and Chevron Corporation, who is a Potentially Responsible Party for the site.
