The Oceana Salvage Site has been under various orders from the Virginia Department of Environmental Quality since the early 1990s to address the unpermitted piles of cracked battery casings and lead contaminated soils. The Responsible Party failed to comply with those orders and dispose of piles of lead contaminated soil and debris. The property is adjacent to a family campground and to the Oceana Naval Air Station.
EPA requires that soils at the Oceana Salvage Yard property be addressed under an Administrative Order on Consent effective September 26th, 2008. The lead-contaminated soils are part of wastes piles which where improperly disposed of under previous orders with the state, and contain elevated levels of lead that pose a threat of exposure to nearby populations.
The RP at the Oceana Salvage Site began work on the treatment and capping of approximately 1000 cubic yards of lead contaminated soils on Tuesday, October 28th.
EPA was on site overseeing the work. As of October 31st approximately 1200 cubic yards of soil and debris were treated using lead binding technology. Both EPA and the RP sampled the treated soils. The soils were tested using the Toxicity Characteristic Leachate Procedure. EPA and the RP took post excavation samples of soils beneath the piles to determine the total lead content of those soils and whether additional excavation would be necessary.
Laboratory results showed that all but one 250 cubic yard soil piles passed TCLP criteria. The pile that did not pass TCLP criteria was re-treated and re-sampled on November 10th. The rest of the piles were graded into the onsite berm.
EPA approved the soil piles to be capped, once laboratory results for the remaining pile showed the soil in the pile passed TCLP. The property owner completed on-site construction work on November 15th, 2008.
Construction work at the site and submittal of reports for site activities from the RP have been completed by RP as of December 5, 2008.
Under the Administrative Order on Consent effective September 26th, 2008, the property owner is still responsible for providing language on the property deed that identifies the location of the treated soils and an appropriate local contact that must be notified before any alternate uses or changes to the berm containing treated soils occur.
The OSC has been working with VDEQ and the City of Virginia Beach to identify a appropriate local entity that will be included on the deed as a point of contact should changes need to be made to the berm of treated soils.
The OSC will provide an supplemental report once this contact is established and the notice to the deed is finalized and this final requirement of the Administrative Order on Consent is met.
