Site Description
This Special Polrep documents the Approval of a "Request for Additional Funding and Exemption from Statutory Limits for a Increase in Scope for the Removal Action at the Hazel Court Enterprises Site"

On this date, Hazardous Substances Cleanup Division Director Abraham Ferdas signed a request for additional funding and increase in scope to address additional work necessary at the Site to to mitigate an imminent and substantial threat to public health, welfare, and the environment posed by the presence of creosote in subsurface soils and in a stream located on the Site which discharges to the Elizabeth River.

During the removal actions this past summer, the OSC was made aware of areas of significant creosote contamination which were not previously known.  Specifically, during excavation of the tanks on Site, the extent of contamination was found to extent beyond the tank farm area.  In fact, the contamination was spread over a triangular area encompassing approximately 4,900 square feet.  The OSC estimates that approximately 2,800 cubic yards of contaminated soil will require removal and disposal.

A stream which runs through the Site also was found to contain heavy concentrations of creosote.  The OSC estimates that 670 cubic yards of sediment will require removal.


Current Activities
Current activities at the Site include offsite negotiations with the property owners and attorneys regarding access and cost recovery issues.  Enforcement has been involved to investigate the possibility of identifying a viable potentially responsible party.  Enforcement actions are confidential and not available for public review.  However, this information is maintained in the file.

Planned Removal Actions
Planned removal actions are as follows:

- Dispose of remaining drums, creosote-contaminated waste, and soil currently staged for disposal;

- Excavate creosote-contaminated soils in areas of the Site which directly impact the Elizabeth River;

- Excavate sediments visibly contaminated with creosote;

- Protect discharge to the Elizabeth River during excavation activities;

- Dispose of wastes


Next Steps
Initial actions will include disposal of drums and contaminated soil on Site.
