On September 26, 2007, EPA and its Superfund Technical Assessment and Response Team III (START) contractor conducted a removal program preliminary assessment/site investigation (PA/SI). Analytical results for the samples collected during the PA/SI indicated the following: 1) Polycyclic aromatic hydrocarbons (PAHs) in the surface soil samples were above Connecticut Remediation Standards, 2) Floor sweeping samples contained high levels of polychlorinated biphenyls (PCBs), and 3) Friable asbestos were present throughout the Capehart Mill building. Based upon the analytical results, the PA/SI was concluded and a time-critical removal action was recommended in the closure memorandum dated January 16, 2008.
On June 11, 2008, the Deputy Director of the Office of Site Remediation and Restoration signed the Action Memorandum for the Capehart Mill Site approving the proposed removal action.
Foot of Fifth, Inc. (Foot of Fifth) has been identified as a potentially responsible party (PRP) as the owner of the site. On September 24, 2008, Foot of Fifth entered into an Administrative Order on Consent (AOC) in which the Foot of Fifth committed to conducting removal activities at the site. Foot of Fifth's contractors, AKRF and Dec-Tam, mobilized to the site on October 27, 2008 to initiate removal activities.
