This biological assessment (BA) evaluates the potential for adverse effects on species and habitats protected under the Endangered Species Act (ESA) from implementation of the Dispersant Use Plan for Region IX, federal Region IX Regional Contingency Plan, Appendix XII, hereafter referred to as the California Dispersant Plan (CDP). The CDP provides a strategy for a the consideration and application of dispersants to a discharge of oil within the boundaries of the State of California and its surrounding waters, extending to the limits of the exclusive economic zone Consistent with the CDP, there is also a pre-approval zone from 3 miles to 200 miles offshore and outside of Marine Sanctuary Boundaries and not within 3 miles of the California/Mexico border for marine waters.
