1.1.1 Incident Category

This is a release involving the illegal disposal of asbestos and asbestos-containing material (ACM).

1.1.2 Site Description

A branch of the NY State Dept. of Environmental Conservation (NYSDEC) requested EPA removal support to remediate 14 bags of friable asbestos containing material (ACM) dumped under an unoccupied trailer in Harpursville, Broome County, NY, approximately 10 miles northeast of Binghamton, NY.  The ACM consists of what appears to be friable insulation and floor tiles.  EPA will coordinate removal and disposal activities with the NYSDEC and NYS Dept. of Labor.

EPA is responding to the request by sending two OSCs and a clean-up contractor to the Site to overpack the bags of ACM and transport them to a permitted disposal facility.

A verbal authorization for $150,000 in response mitigation funds has been given by Walter Mugdan, Director ERRD, on November 1, 2010.  A DCN has been assigned and the ERRS contractor has been notified to respond to the Site NLT noon on 11/2/2010.

This incident is being investigated by state and federal law enforcement agencies.
