1.1.1 Incident Category

This is a release involving the illegal disposal of asbestos and asbestos-containing material (ACM).

1.1.2 Site Description

A branch of the NY State Dept. of Environmental Conservation (NYSDEC) requested EPA removal support to remediate 14 bags of friable asbestos containing material (ACM) dumped under an unoccupied trailer in Harpursville, Broome County, NY, approximately 10 miles northeast of Binghamton, NY.  The ACM consists of what appears to be friable insulation and floor tiles.  EPA OSCs coordinated the removal and disposal activities with the NYSDEC and NYS Dept. of Labor.

EPA responded to the request by sending two OSCs and a clean-up contractor to the Site to overpack the bags of ACM and transport them to a permitted disposal facility.

1.1.2.2 Description of Threat

Release of asbestos and ACM to the environment and the general public being exposed to ACM from improper handling of the garbage bags.

1.1.3 Preliminary Removal Assessment/Removal Site Inspection Results

Upon arriving at the Site the OSCs observed 14 single-wrapped black plastic garbage bags filled with wetted ACM.  Although some of the bags had broken open, an examination of the ground under and near the bags did not reveal any asbestos contamination.


2. Current Activities

    2.1.1 Narrative

THE PURPOSE OF THIS POLREP IS ONLY TO ADD ADMINISTRATIVE INFORMATION TO THE RECORD
AS HIGHLIGHTED IN SECTION 2.1.2 BELOW.

2.1.2 Response Actions to Date

A verbal authorization for $150,000 in response mitigation funds has been given by Walter Mugdan, Director ERRD, on November 1, 2010.  A DCN has been assigned and the ERRS contractor has been notified to respond to the Site NLT noon on 11/2/2010.

On 11/3/2010 EPA ERRS contractor personnel with Kemron Environmental Services met the OSCs at the Site.  ERRS crew double bagged each of the 14 bags and bulked them into 55-gallon salvage drums.  EPA RCRA waste labels and DOT shipping labels were affixed and the drums were transported to Sunstream Corp in Binghamton, NY for temporary storage while DEC investigators examined the contents of the bags.  The ACM will be transported to the Broome County LF for final disposal on 11/4/2010. 

Documentation has been received which confirms the bags of ACM have been disposed of at the Broome County Landfill in Binghamton, NY.

This incident is being investigated by state and federal law enforcement agencies.  Information obtained from this investigation will be given to the OSCs for possible cost-recovery action.
