Emergency Response for abandoned drums in a residential neighborhood.
1.1.2 Site Description
Two 35-gallon drums abandoned in the rear of a vacant residence.
1.1.2.1 Location
The site is in a residential area of closely situated houses.
1.1.2.2 Description of Threat
Drum of waste oil and drum of waste paint abandoned in an open rear yard that is accessible to trespassers and vandals.
1.1.3 Preliminary Removal Assessment/Removal Site Inspection Results
OSC accessed the site on 9/16/2015 and visually identified one drum of used oil and one drum of waste paint.

2.1.2 Response Actions to Date
The OSC conducted a visual assessment of the property on 9/16/2015.
Authorization for emergency removal action and funding authorized on 9/24/2015.
ERRS mobilized crew to site on 9/29/2015, overpacked drums and relocated them to the DPW yard in Ellenville for temporary storage pursuant to NCP.
On 9/29/2015 the OSC and ERRS contractor mobilized to the Site. A rep with the Ellenville HD met the OSC at the Site. Upon closer examination of the drums it was discovered that the drum that appeared to contain used oil in fact contained water with a thin layer of oil on top. The oil appeared to have overflowed onto the surrounding soil and an old carpet that covered part of the patio. The ERRS contractor cleaned the waste paint drum and overpacked it. The used oil drum was emptied and stacked with the garbage. The ERRS contractor shoveled the contaminated soil into a lined overpack drum, then cut the oil-soaked carpet into sections and overpacked them as well. Both overpack drums were transported to the Ellenville DPW yard. The waste paint drum will be transferred to the Ulster County Resource Recovery Authority facility in Kingston where it will be integrated with the County's HHW wastes. The drum of oil-soaked material will be shipped by ERRS under a non-hazardous waste manifest from the DPW yard for disposal as solid waste.
The drum of waste solvent-borne paint was transferred from the Ellenville DPW yard to the Ulster County Resouce Recovery Authority facility in New Paltz as HHW. The remaining drum of used oil-soaked debris was shipped to a landfill in Vermont.
2.1.3 Enforcement Activities, Identity of Potentially Responsible Parties (PRPs)
The potentially responsible party identified to date is the current property owner, Robert J. Stewart. Mr. Steward provided the OSC with verbal authorization to access his property to conduct this removal action.
