On the morning of Tuesday 15 October, DNREC called the Region 3 response line.  DNREC advised EPA that a warrant was being served at a warehouse located in the city of New Castle, New Castle County, Delaware and that DNREC might possibly be requesting EPA support later in the day.   Delaware’s environmental protection officers are investigating possible illegal storage of hazardous waste.   Region 3 CID was advised of this pending request.

1.1.2 Site Description
The warehouse is located in Bay West Industrial Park near the intersection of Route 9 and Grantham Road, along the Delaware River.  The warehouse is approximately 50,000 square and is composed of two large storage areas and a small office. The building is in complete disarray.  Outside of the warehouse are about 15, 40-foot trailers and one tractor that belong to the PRP.

1.1.3 Description of Threat

Located in one half of the warehouse were approximately 12, 55-gallon drums.  The drums contain a conglomeration of paint wastes allegedly from the consolidation of drums that the PRP was cleaning and reconditioning.  Hazardous categorization indicated high vapor pressure substances and an approximate 70% explosive level above the head space of the drums.  The drums also show evidence of leaking and possible failure due to rust and damage.  The area surrounding the drums was rich in the smell of aromatic compounds.  The contents of one drum also tested positive for corrosivity.

1.1.3 Preliminary Removal Assessment/Removal Site Inspection Results
Based on the readings of the search warrant team and my observations, that the drums present an imminent danger of fire, which would severely threaten other health and safety of workers in the industrial park, as well as firefighters that would be called to extinguish the fire and protect adjoining and nearby warehouse and offices. 

2. Current Activities
  2.1 Operations Section
    2.1.1 Narrative
      On the morning 10/16/2013 the OSC responded with START contractor.  A DNREC OSC was also present.  The 12 drums were sampled for characteristics and disposal profiles.  High levels of organic vapors were observed during the sampling process.
     The warehouse and trailer were inspected and no significant other items were noted.
2.1.2 Response Actions to Date
      DNREC issued a Secretary's Order which was voluntarily signed by the PRP.  This order requires the PRP to over pack and remove the drums for disposal.  The PRP has hired a qualified licensed contractor to conduct the work.  EPA will provide the contractor with the disposal profiles when they are received. At that point the PRP has 7 days to ship the drums for proper disposal.

The owner of Recyclers of Delaware has been identified.  DNREC is conducting an investigation at this time and EPA CID is coordinating their efforts in concert.
