Activities at this site are pursuant to Section 311(c) Federal Water Pollution Control Act (“FWPCA”), as amended by the Clean Water Act §311, as amended by the Oil Pollution Act of 1990 (“OPA”), Public Law 101-380, and in accordance with the National Oil and Hazardous Substances Pollution Contingency Plan (“NCP”).
EPA Telephone Duty Officer referred NRC spill report # 711788 to the Maryland Department of the Environment, Emergency Response Division (MDE). NRC report #711788 was dated 01/28/04. On 03/30/04 MDE requested EPA assistance with subject release.
The property is owned by the Episcopal Ministries to the Aging Inc. (EMA). The site is located on a 300 acre parcel of property, owned by EMA, just off 580 Obrecht Rd. in Sykesville, Carroll County, Maryland.
Subject location is a rural setting on the outskirts of Sykesville. Sykesville is located in Carroll County, Maryland. The Site is a wooded area at the bottom of a steep slope, immediately adjacent to an unnamed creek. Very obvious diesel fuel was noticed surfacing thru an underground spring and discharging into the unnamed creek feeding the Piney Run. The Piney Run is a tributary to the larger Patapsco River. MDE personnel had enlisted the services of an environmental cleanup contractor (HMHTTC) since early March, 2004 to mitigate the release by placement of sorbent pads and boom at the seep location and in the unnamed creek. MDE and its contractor continued to perform weekly/biweekly maintenance of the boom and pads until referred to EPA.
On March 30, 2004, MDE requested EPA Region III Removal Response Section assistance. EPA OSC Fitzsimmons was assigned the lead.
The EPA OSC issued a Pollution Removal Funding Authorization (PRFA) to the US Army Corps of Engineers (USACE), Baltimore District, on 4/8/04 in the amount of $40,000. The PRFA requires the USACE to provide a scope of work that will describe the approach to seep mitigation and source determination. It also allows for the USACE to hire a cleanup contractor to perform the seep mitigation activities and to generate a plan for source determination. In addition it requires the USACE to submit routine reports and to perform cost tracking and to alert the OSC when 75% of the allocated ceiling has been reached.
After approximately one year of investigatory work into the origin of this release, the FOSC issued an Administrative Order on Consent, under the Clean Water Act Section 311 (c) and (e) authority, to nearby Fogle's Septic Clean Inc. On April 26, 2005 Fogle's signed and on April 27, 2005, the Director Hazardous Site Cleanup Division, EPA Region III signed thereby certifying its effective date. The FOSC continues to oversee the subject order with Fogle's and its contractors to ensure the completion of all removal activities.
