On April 1, 2003, EPA filed a Resource Conservation and Recovery Act (RCRA) Expedited Settlement
Agreement (ESA) with Feeler Lumber, LLC. As part of the ESA, Feeler Lumber was required to return to compliance with hazardous waste regulations, and submit both a
Site Characterization Work Plan and a Clean-up Action Work Plan and Report. Feeler Lumber failed to submit any of the required work plans and reports before
going out of business. It is unknown when Feeler Lumber ceased operations.
On
May 30, 2017, the Region 7 EPA RCRA
program referred
the Site to the EPA Region 7's Superfund program for further investigation. Structures and containers remaining at the Site
included a treatment building, sawmill building, storage building, a
4,000-gallon PCP Above-ground Storage Tank (AST), small PCP AST, and a large
treatment cylinder assumed to contain wood treatment wastes.
In
June 2020, EPA Region 7 conducted removal site evaluation field sampling activities. EPA
sampled soils and the one AST
that are located behind the treatment facility. It was determined that the AST the
4,000-gallon AST was a quarter full. The smaller PCP AST did not contain enough waste
to sample. The treatment building was inaccessible; therefore, no sample was
collected from the large treatment cylinder.
EPA conducted a Time-Critical Removal action on March 13, 2023. The AST tank and pressure treating vessel were removed from the property and the secondary containment impoundments were filled with clay. A deed notice was placed on the property and is available at the Maries County office.
